WILL AND ADMINISTRATION OF
ARTHUR DRYDEN STERRY (1897)

 
 I Arthur Dryden Sterry of 45 Richmond Grove West in Longsight near the City of Manchester in the county of Lancaster Merchant hereby revoke all testamentary dispositions heretofore made by me and declare this to be my last Will which I make this nineteenth day of April one thousand eight hundred and ninety five. I appoint my friends Percy Lupton at present residing at San Paulo in Brazil in South America Merchant and Frank Mills of 6 Dickinson Street in the said City of Manchester Merchant to be the Executors and Trustees of this my will and they or the survivor of them or the executors or administrators of such survivor or other the trustees or trustee for the time being hereof are hereinafter called the trustees or trustee And I bequeath to each of them if he shall accept the office of trustee and Executor the sum of one hundred pounds. I appoint my dear Wife Ambrosina Augusta and after her death the trustees or trustee hereof Guardian and Guardians of my infant children. I bequeathe unto my said Wife the legacy or sum of five hundred pounds to be payable within one calendar month after my death to answer her immediate requirements. I bequeath unto my said wife all my jewellery trinkets watches ornaments of the person and wearing apparel and all my wines provisions and other household consumable stores for her own absolute use. I also bequeath to my said wife my household furniture plate linen china printed books pictures musical instruments tincents(?) fixtures and other household effects (but not including in this bequest my moneys securities of money legal documents or effects of that nature) which shall be in or about my dwelling house or dwelling houses which at the time of my death I shall be residing in or keeping up as a residence or residences for myself for her own use absolutely. I also bequeath to my said Wife all that my Tonkire(?) Life Policy in the New York Life Insurance Company for ten thousand dollars together with all benefits thereunder for her own use absolutely. I devise and bequeath all the real and personal estate to which at my death I shall be beneficially entitled or of which I shall have power to dispose beneficially by will for any purpose I may think proper and not hereby otherwise disposed of unto the Trustees hereinbefore named absolutely upon trust to see the said real estate (including chattels real) and to call in sell and convert into money such part of my personal estate as shall not consist of money with power to postpone such sale and conversion for such a period as the trustees or trustee may think proper. And I direct that until a sale of the said real estate the Trustees or Trustee may leave the same for any term not exceeding twenty one years at the best rent to be reasonably obtained without taking a fine. And that the rents and profits thereof or of so much thereof as for the time being remains unsold shall after payment thereout of all rates taxes costs of insurance and repairs and all other outgoings be paid or applied to the persons or in the manner to whom or in which the income of the produce thereof is hereinafter to be paid and applied. And I direct the trustees or trustee out of the moneys to arise from the sale and conversion of my said real and personal estate and out of my ready money to pay my funeral and testamentary expenses and debts and the legacies bequeathed hereby or by my Codicil hereto and to stand possessed of the residue of the said money and of the investments for the time being representing the same (hereinafter called the trust fund) and of the income thereof upon trust to pay the said income to my said wife or to permit her to receive the same during her life. And from and after the death of my said wife I direct that the trustees or trustee shall stand possessed of all the said trust fund and of the income thereof In trust for all my children or any my child living at my death who being sons or a son attain the age of twenty one years or being daughters or a daughter attain that age or marry under that age such children if more than one to take in equal shares as hereunto in common and for all children of such of them as shall die in my lifetime or being sons or son shall die under the said age of twenty one years such children of any child of mine taking respectively per stirpes the share which his her or their deceased parent would have been entitled to had he or she survived me and attained the age of twenty one years. I empower the trustees or trustee at any time and from time to time after the death of my said Wife or during her widowhood with her consent in writing to raise any part of parts not exceding together one half of the presumptive or vested share of my child or other issue of mine under the trusts hereinbefore declared and to pay or apply the same for the advancement or benefit of such issue as the trustes or trustee may think proper And I declare that it be shall be lawful for the trustees or trustee from time to time to invest in moneys which shall for the time being be subject to the trusts or provisions of this my will and which shall not be immediately payable or distributable either in or upon any of the public stocks or funds in Government securities of Great Britain or India or any other Colony or Dependancy of the United Kingdom or a mortgage of freehold or leasehold or other real property in England or Wales or upon the Bonds debentures or other securities of any Company or other Corporation in Great Britain incorporated by Act of Parliament or Royal Charter and paying interest or dividend or upon the security or in the purchase of preferences or guaranteed shares or stock of any such Company or Corporation as aforesaid with power for the said trustees or trustee for using any such investments at discretion. In witness whereof I have to this and two proceding sheets of paper on which this my will is contained set my hand the day and year first before written.

On the 17th day of September 1897 Administration with this will of the Effects of the Testator was granted at Manchester to Ambrosina Augusta Sterry Widow Relict the Residuary Legatee for life.

BE IT KNOWN, that Arthur Dryden Sterry of 45 Richmond Grove West Longsight in the City of Manchester Merchant deceased, who died on the 13th day of April 1897 at 45 Richmond Grove West aforesaid and who at the time of his death has a fixed place of abode at 45 Richmond Grove West aforesaid within the District of (deleted) made and duly executed his last Will and Testament ___ and did ___ therein name
Percy Lupton and Frank Mills Executors and Residuary Legatees In Trust who have duly renounced Probate and Execution thereof.
AND BE IT FURTHER KNOWN, that at the date hereunder written, Letters of Administration with the Will annexed of the personal estate of the said Arthur Dryden Sterry deceased were granted by Her Majesty's High Court of Justice at the District Registry attached to the Probate Division thereof at (deleted) to Ambrosina Augusta Sterry of 45 Richmond Grove West aforesaid Widow the Relict of the said Deceased the Residuary Legatee for life, named in the said Will, she having been first sworn and faithfully to administer the same
