WILL OF SIR WASEY STERRY,
WINDSOR, BERKSHIRE, 1955
This is the last Will and Testament of me Sir Wasey Sterry, C.B.E., formerly Chief Justice and Legal Secretary of the Anglo Egyptian Sudan and subsequently Judge of His Britannic Majesty's Supreme Court of Egypt and now residing at 5, Clarence Crescent, Windsor, Berkshire.
- I REVOKE all Wills and Codicils heretofore made by me
- I APPOINT my dear wife Renee Marie Lydie Sterry my friend Nicholas Robin Udal C.B.E. of The Athenaeum, Pall Mall, London, SW1 and Archibald Louis Hugh Carter of 5, Bedford Row, London, WC1, Solicitor (hereinafter called "my Trustees") to be the Executors and Trustees of this my Will and Trustees for all purposes of the Law of Property Acts and the Settled Land Act and I GIVE to the said Nicholas Robin Udal Fifty pounds free of all duty if he accepts the office of Executor and Trustee.
- I GIVE One hundred pounds free of all duty to my god-daughter Brigitte Salles my Wife's niece and a like sum of One hundred pounds free of all duty to my godson Bernard Rene Pinatton my Wife's nephew.
- I GIVE to my brother Francis Middleton Sterry or if he shall predecease me to his son my godson Peter Wasey Francis Sterry all my private papers family letters and records not required by my Executors which I hope may be preserved as containing a good deal or family history and matters of interest hereafter to future generations.
- I LEAVE to the Provost and Fellows of Eton College all my collections for Etonian biography and books pamphlets newspaper cuttings and writings relating to the College and School and I suggest to them to consult my friend Richard Austen-Leigh as to what should be preserved AND I GIVE to them also for the College Library my copy of Dr. Venn's Alumni Cantabrigienses both Parts and if the Second Part is not complete at the time of my death they should make application to Dr. Venn now President of Queens, College Cambridge for the further volumes to be completed which have been promised to me by Dr. Venn.
- I GIVE to my Wife
(1) AN immediate legacy of five hundred pounds free of all duty
(2) SUBJECT to the exceptions and provisions herein contained all furniture linen glass china prints photographs plate and plated articles jewellery and ornaments of the person motor cars and all other general effects of household domestic or outdoor use or ornament in or about the house where I am now residing which are not already hers
(3) A LEGACY of One thousand five hundred pounds free of all duty to be paid in the ordinary course of administration.
- I EXCEPT from the absolute gift to my Wife contained in sub-section E of the last paragraph hereof
(a) ALL prints and family.portraits drawings miniatures china plate and plated articles inherited from my father and mother and any other family relics inherited from or given to me by either of them in their lifetimes including the silver Cake Basket formerly my grandfather's given me on my marriage by my aunt Mrs. Frances Holden
(b) I ALSO EXCEPT from the said absolute gift to my Wife the Pearl Necklace formerly the property of my grandmother Frances Sterry and given her by her father Thomas Tourle of Landport Sussex and the Pearl Pin formerly the property of my grandfather Wasey Sterry which were left to me by my sister Emily Frances Sterry and also the large China Jar bought by my great grandmother Mary Ann Tourle at the sale of the contents of the Brighton Pavilion.
I DIRECT that my Wife shall have the use and enjoyment of all such excepted articles or any of them that she may select for her life without being liable for any accidental loss or injury thereto and subject to such right of use and enjoyment of my Wife for life I DIRECT that such excepted articles shall go to my said brother for his life and after his death to his son the said Peter Wasey Francis Sterry absolutely or in the event of his death in the lifetime of the survivor of my Wife and my said brother to my niece Ann Louise Sterry absolutely.
- AS REGARDS my books I LEAVE them to my Wife and request her but without creating any legal obligation to dispose of such of them as are mentioned in any memorandum signed by me and deposited with my Will in accordance
with such memorandum and in the event of my Wife's death in my lifetime I LEAVE the books mentioned in any such memorandum to my Trustees to be disposed of by them in accordance with such Memorandum
- I DEVISE and BEQUEATH all the real and personal property not hereby or by any Codicil hereto otherwise specifically disposed of and which I can dispose of by Will in any manner I think proper either as beneficially entitled thereto or under any general power unto my trustees upon Trust that my Trustees shall sell call in and convert into money the said real and personal property at such time or times and in such manner as they shall think fit but as to reversionary property not until it falls into possession unless it should appear to my Trustees that an earlier sale would be beneficial with power to postpone the sale calling in and conversion of the whole or any part or parts of the said property including leasehold or other property of a terminable hazardous or wasting nature during such period as they shall think proper and to retain any investments existing at my death without being responsible for loss and I DIRECT that the income of such of the same premises as for the time being shall remain unsold shall from my death be applied as if the same were income arising from investments hereinafter directed to be made of the proceeds of sale thereof and that no reversionary or other property not actually producing income shall be treated as producing income for the purposes of this my Will.
- MY TRUSTEES shall out of the moneys to arise from the sale calling in and conversion of or forming part of my real and personal estate and out of my ready money pay my funeral and testamentary expenses and debts and the pecuniary legacies bequeathed by this my Will or by any Codicil hereto and make provision for any annuity so bequeathed and pay all death duties payable on my real estate including chattels real
- MY TRUSTEES shall invest the residue of the said moneys (which moneys and the property for the time being representing the same are hereinafter called "the Trust Fund") in the names of my Trustees in or upon any of the investments hereby authorised with power to vary or transpose such investments for others of a like nature
- MY TRUSTEES shall pay the income of the Trust fund and of the property for the time being representing the same to my Wife during her life
- AFTER the death of my Wife my Trustees shall hold the Trust Fund and the income thereof In Trust
(1) To PAY a legacy of One thousand pounds free of duty to the provost and fellows of Eton College for the benefit of the said College as some acknowledgment of the benefit I and others of my family and relations have received from the bounty of King Henry VI and
(2) TO PAY a legacy of Two hundred and fifty pounds free of duty to the Warden And Fellows of Merton College Oxford for the benefit of their scholarship fund
AND I DECLARE that the receipts of the Bursars of such Colleges shall be a sufficient discharge for the said legacies
- SUBJECT to the payment of the said two legacies my Trustees shall hold the Trust Fund upon the following trusts namely
(a) DURING the lifetime of the last survivor of'such of my brother and sisters as shall be living at the death of the survivor of my said Wife and myself Upon Trust to pay the income to such one or more of my brother and sisters as aforesaid and if more than one in equal shares and after the death during this period of any of such of my brother.and sisters as aforesaid to divide the share of the income of the one so dying between such of them my said nephew and niece Peter Wasey Francis Sterry and Anne Louise Sterry as shall be living at the death of the survivor of my said Wife and myself and if both in equal shares AND I DIRECT that if my said brother shall have predeceased the survivor of myself and my said Wife the share of the income of the Trust Fund which would otherwise hereby have become payable to him shall be paid to such of his said children as shall be living at the death of such survivor and if both in equal shares
(b) AFTER the death of the last survivor of my said brother and sisters or on the death of my Wife if my brother and sisters shall all have predeceased her my Trustees shall hold the Trust Fund In Trust as to both capital and income for such of them the said Peter Wassy Francis Sterry and Anne Louise Sterry an shall be living at the death of the survivor of myself and my said Wife and if both in equal shares absolutely PROVIDED that if either of them the said Peter Wasey Francis Sterry or Anne Louise Sterry shall die in the lifetime of the survivor of myself and my said Wife leaving issue
any of whom shall be living at the death of such survivor such issue living at the death of such survivor shall take equally amongst them if more than one the share of the Trust Fund which their respective parent would have taken if living at. the death of such survivor.
- NOTWITHSTANDING anything contained in the last preceding clause hereof I IMPOWER MY Trustees if they think it desirable instead of paying his her or their share to either of them my said nephew or niece or their respective
issue to settle the same for his her or their benefit or protection so far as the law permits
- IN CASE there shall be a complete failure of the trusts hereby declared so that the whole or any part of the Trust Fund shall in the event be undisposed of I APPOINT the aforementioned Provost and Fellows of Eton College to be my residuary legatees.
- THE TRUST MONEYS may be invested in or upon such investments (other than merely personal credit Shares not fully paid up and Shares or securities to Bearer and real securities in Ireland) as my Trustees shall in their absolute discretion. think fit as if they were absolutely entitled thereto beneficially.
- THE POWER of appointing a new Trustee or Trustees of my Will shall be vested in my said Wife during her life but in the event of her decease when Sole Trustee without appointment made then I NOMINATE.the National Provincial Bank Limited as Trustee with power for the said Bank to make the usual charges
- IN VIEW of the greatly increased risks in these days of my Wife and myself dying in or through some comon disaster I DIRECT and DECLARE that if my said Wife shall not be shown to have survived me for the space of one calendar month then the gifts made to her under Clause 6 hereof and the further provisions. made hereby for her benefit shall be null and void as if she had died in my lifetime.
- ANY EXECUTOR or Trustee of my Will being a Solicitor or other person engaged in any profession or business shall be entitled to charge and be paid all proper professional or other charges for business transacted time expended or acts done by him or his firm in the administration of my estate or the execution of the trusts of my Will including acts which an Executor or Trustee not. being in any profession or business could have done personally.

I, Sir WASEY STERRY C.B.E. of 5, Clarence Crescent, Windsor, Berkshire, DECLARE this to be a First Codicil which I make this twentieth day of April one hundred and fifty three to my Will which is dated the twenty first day of March One thousand nine hundred and fifty two.
- I REVOKE Clause 19 of my said Will
- AS some acknowledgment of many kindnesses and much hospitality received from them I LEAVE to my Wife's Sister Madame Marcelle Pinatton now of the Hotel Roncevay 10, Boulevard Montmartre, Paris (9) France the sum of Five hundred pounds AND to my wife's sister Madame Lucienne Salles now of 4, Rue Charles Amans, Montpellier (Hersult) France the like sum of Five hundred pounds to be paid to them on the death of my wife AND if either of them be then dead the legacy to her shall be divided equally between her children then living and if there be no such child such legacy shall accrue to the legacy of the other sister or her children.
- IN all other respects I CONFIRM my said Will.

This is a second codicil to the will of me Sir Wasey Sterry dated 21 March 1952
- Instead of the legacy of £1500 fifteen hundred pounds to my wife under paragraph 6 clause 3 I substitute the sum of £2500 two thosand five hundred pounds free of all duty to be paid in the ordinary course of administration.
- After the word 'china' in the first line of cluse (a) of paragraph 7 of my will the following words shall be inserted "including the large dinner service known in my family as the Worcester dinner service whether it is of Worcester manufacture or not."
In Witness whereof I have hereunto set my hand this seventh day of February 1954.

BE it KNOWN that Sir WASEY STERRY Knight C.B.E. of 5 Clarence Crescent Windsor Berkshire
died there on the 9th day of August 1955 domiciled in England AND BE IT FURTHER KNOWN that at the date hereunder written the last Will and Testament with two codicils thereto (a copy whereof is herounto annexed) of the said deceased was proved and registered in the Principal Probate Registry of the High Court of Justice and that Administration of all the estate which by law devolves to and vests in the personal representative of the said deceased was granted by the aforesaid Court to RENEE MARIE LYDIE Lady STERRY of 5 Clarence Crescent aforesaid widow the relict of duceased NICHOLAS ROBIN UDAL C.B.E. of 43 Wetherby Mansions London S.W.5 Sudan civil servant retired and ARCHIBALD LOUIS HUGH CARTER of 6 Bedford Row London W.C.1 solicitor the executors named in the said will
And it is hereby certified that an Inland Revenue affidavit has been delivered wherein it is shown that the gross value of the said estate in Great Britain (exclusive of what the said deceased may have been possessed of or entitled to as a trustee and not beneficially) amounts to £44557-9-2 And it is further certified that it appears signed by an Inland Revenue officer on the said affidavit that £12518-9-2 on account of estate duty and interest on such duty has been paid.
