WILL OF GEORGE STERRY,
WORCESTER, 1856

 

I George Sterry write this as a Memmorandom of my wife and will as regards the disposall of my real leasehold personall and all other property I now possess I appoint my wife Mary Ann Sterry & my friend Mr William Higgs Auctione Worcester my Executors & Trustees and request they will after my death cause my body to be plainly and respectfully intered & with the value of my share and propperty in the business of Carver & Gilder carried on by me in partnership with Mr T E Doe cause my just debts & funerall expenses to be paid & should there be any ballan (balance?) in cash remain over & above what may be required for the above named purpose I request it may be given to my wife Mary Ann Sterry I also give to my said wife for the full term of her naturall life the whole income derived from all & every property I shall at my decease be in possession off viz my house garden & buildings thereto belong with all it contains to live in or lett as she may find convenant (covenient?) and the net income received for my cottage both of which are situated at Newtown parish of St Martin Worcestershire Also the net income received from my leasehold property situate in Mary Ann Street Birmingham Warwickshire also the net income received from my freehold property situated in St Paul Street parish of St Peter Worcester also the half yearly dividends paid for my twenty seven shares in the Worcester New Gas Company All the above named incoms I give to my wife Mary Ann Sterry on condition she regularly pays to Mr William Higgs Auctione Worcester the interest accsiding(?) to mortgage deed for six hundred pounds borrowed at four per cent per annum amounting to twelve pounds half yearly one in March & September At the death of my wife Mary Ann Sterry I wish all income received from my property to be received by Mr W Higgs & any other person my wife may appoint to succeed her as Executor after her decease to be placed in the Worcester & co Bank or lent on mortgage till it amounts to such a sum as shall pay Mr Higgs or his executors & administrators the full amount of six hundred pounds & interest according to agreement and full satisfaction I then desire the whole of the property may be disposed of as follows To my daughter Lucy Sterry I give free from all control of her will the house premisses & all it contains & the cottage adjoining or near to situate at Newtown St Martins Worcestershire & all my twenty seven Gas shares in the Worcester New Gas Company with power to will and bequeath to whom she pleases I give to my daughter after the mortgage due to Mr Higgs is paid off the whole of my freehold propperty in St Paul Street parish of St Peter Worcester & also after the mortgage due to Mr Higgs is paid off the net income received from my leasehold property in Mary Ann Street Brimingham for the unexpired term of lease that may have to run with full power to bequeath or dispose of to whomsoever she may please This my Will I sighn in the presence of the two undersighned persons. In the Goods of Mr George Sterry deceased
Appeared personally Charles Coxall of the
parish of Saint Martin in the City of Worcester frame maker and made oath that he is one of the subscribed witnesses to the last will and testament hereunto annexed of the said George Sterry late of the parish of Saint Martin in the county of Worcester deceased bearing date the nineteenth day of July one thousand eight hundred and fifty two and the deponant further made oath that one the said nineteenth day of July one thousand eight hundred and fifty two the said testator duly executed his said will by signing his name at the foot or end thereof in the presence of this deponent and of Samuel Allen the other subscribed witness thereto who were both present at the same time and this deponent and the said Samuel Allen thereupon attested and subscribed the said Will in the presence of the said testator and of each other - Charles Coxall
On the twenty first day of October 1856 the said Charles Coxall was duly sworn to the truth of this Affidavit by virtue of the annexed Commission. Before me - Thomas S Wheeler (Commissioner)

Proved at London 25th October 1856 before the Judge by the oath of Mary Ann Sterry widow the relict the Executrix named in the said Will with power of appointment as therein mentioned to whom admon was granted having been first sworn by Comon (Commission?) duly to administer power reserved of granting probate of the said will to William Higgs, the Executor named in the said will when he shall apply for the same.

Note: George Sterry of 11 High St, Worcester, Carver & Gilder and a Paul Sterry of 10 High St, Worcester, Engraver, both appear in Pigot & Co Directory for Worcester 1828/29.
