WILL OF HENRY STERRY,
MIDDLESEX, 1787
I Henry Sterry of Moor Place in the county of Middlesex do make this my last Will and Testament as follows I give to my executors hereinafter named nine thousand pounds fourpercent Bank annuities in trust to stand possessed thereof and to transfer the same unto my three children Hannah Henry and Mary severally when they when they shall respectively attain the age of twenty one years equally share and share alike and to the survivors and survivor of them if either of them shall die before the said age in the mean time to permit and suffer my dear wife Mary Sterry to receive and take the dividend and interest of the said annuities to and for her own use I give unto my said executors six thousand pounds Bank stock in trust to stand possessed thereof and to permit and suffer my said wife to receive and take the dividends and interest thereof to and for her own use for and during her natural life and from and after her decease intrust to transfer the said stock unto my aforesaid three children and to the survivors and survivor of them severally at their respective ages of twenty one years equally share and share alike and in case all my said children shall die before attaining the said age than I direct as well the said nine thousand pounds annuities as the said six thousand pounds stock do sink into and become part of the residue of my estate and I give all the rest and residue of my estate and effects whatsoever and wheresoever the same may consist of or at the time of my decease unto my said wife her executors administrators and assigns and do appoint my said wife together with my brother in law Thomas Horne Anthony Horne his son and my ffriends Thomas Lister of Long Lane Southwark and Adey(?) Bellamy of the Poultry London executrix and executors of this my Will hereby revoking all others by me heretofore made In witness whereof I have hereunto set my hand and seal this ninth day of January in the year of our Lord one thousand seven hundred and eighty seven - Henry Sterry - Signed sealed published and declared by the said Henry Sterry as and for his last Will and Testament in the presence of us Midse(?) Young, Doctor Coum...(?), Jno(?) Weston his clerk
First by way of codicil to my Will above written and by way of explanation thereof I do hereby declare that my mind and will expressly is that my daughters Hannah and Mary Sterry shall not be entitled to receive nor shall my executors transfer to either of them any part of the above mentioned nine thousand pounds annuities or six thousand pounds stock which I have bequeathed to them in manner above expressed until they shall severally and respectively attain the age of twenty one years or be married with the consent of my executors above named which shall first happen. In witness whereof I have here unto set my hand this second day second month (called ffeb) one thousand seven hundred and eighty seven - Henry Sterry
Second by way of codicil to this my Will above written I give to my ffour executors above mentioned one hundred pounds each to my sister in law Elizabeth Howitt twenty pounds to her daughter Harriett Bercelou twenty pounds to my cousins as follows Thomas La.....(?), Elizabeth Griffin, Sarah Mattocks, Rebekkah Salmon, Bea...(?) Landifield(?), Sarah Jefferys to each ten pounds to L...(?) St(?) H...(?), Alderman Newman ten pounds and to his son Henry ten pounds To the monthly meeting of ffr'ds(Friends?) at the Peel ninety pounds - Henry Sterry - ffourteenth day second month (called ffeb'y) one thousand seven hundred eighty seven.
Third By way of codicil to this my Will and for information thereof to my executors whereas I have hereby given to my four executors before mentioned the sum of six thousand pounds Bank stock in trust for my three children and as I have very lately sold out the said stock and purchased with the amount thereof into the ffive percents cons(consol?) anno now do hereby cauce the aforesaid legacy of six thousand pounds bank stock and in the room thereof leave the sum of six thousand pounds ffive p. consol(?) anno(?) to my ffour executors above mentioned and for the purposes therein mentioned in this my Will and also under the same limitations and restrictions enjoined in the first codicil hereunto annexed - Henry Sterry tenth day of ffifth month (called May) 1787 one thousand seven hundred and eighty seven.
18th December 1787
Appeared personally John Newman of Snow Hill in the parish of Saint Sepulchre Currier and Lancelot Baxter of Bridgewater Square in the parish of Saint Giles Cripplegate London Clerk to the said Mr Newman and being from on the Holy Evangelists to depose the ___(?) made oath that they well know and were acquainted with Henry Sterry formerly of Moore Place in the County of Middlesex but late of the parish of Saint Andrews Holborn in the same County deceased for several years before and to the time of his death also with his manner and character of hand writing and subscription having often seen him write and write and subscribe his name to writings and having now carefully examined the writings hereinto annexed purporting to be three codicils to the last Will and Testament of the said deceased the first of the said codicils beginning thus "By way of codicil to my last Will above written and by way of explanation thereof" ending thus "In witness whereof I have hereunto set my hand this second 2d day second month (called ffeb) one thousand seven hundred eighty seven" and thus subscribed "Henry Sterry" the third codicil beginning thus "By way of codicil to this my Will and for information thereof to my executors" ending thus "and also under the same limitations and restrictions enjoined in the first codicil hereunto annexed" dated tenth day of ffifth month called May 1787 one thousand seven hundred and eighty seven" and thus subscribed "Henry Sterry" they these deponents jointly and severally declare verily and in their consciences believe that whole body series and contents of the above in part verified(?) codicils beginning aiding dated and subscribed as aforesaid to be all of the proper hand writing and subscription of the said deceased - John Newman, Lancelot Baxter, Jane Day (_urt?) wth Docr The said John Newman and Lancelot Baxter were sworn to this affidavit before me Wm Scott Surrogate present Nathl. Bishop notary publ.
This Will was proved at London with three codicils the twenty fourth day of December in the year of our Lord one thousand seven hundred and eighty seven before the Worshipful William Scott Doctor of Laws Surrogate of the Right Worshipful Peter Calvert also Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by Mary Sterry, widow the relict of the deceased Thomas Horne, Anthony Horne, Thomas Lister, Adey Bellamy the executors named in the said Will to whom administration was granted of all and singular the goods chattels and credits of the said deceased having first made a solemn and sincere declaration or affirmation according to Act of Parliament duly to administer.
