WILL OF NUCE STERRY,
SURREY, 1774

 

In the Name of God Amen
I Nuce Sterry of Wandsworth in the County of Surry Carpenter being of sound mind memory and understanding do make and declare this to be my last Will and Testament in manner and form following that is to say ffirst and principally I resign my Soul into the hands of Almighty God my Creator hoping for a joyful Resurrection through the merits of my blessed Redeemer Jesus Christ and my body I commit to the Earth to be decently buried at the discretion of my Executor hereinafter named And I do hereby give and devise and bequeath all and every my freehold messuages or tenements and hereditaments with their and every of their appurtenances situate lying and being at the Bank Side Southwark in the County of Surry or elsewhere unto John Chapman of Wandsworth aforesaid schoolmaster and to his heirs and assigns for ever to the use of the said John Chapman his heirs and assigns for ever nevertheless upon several trusts ends intents and purposes hereinafter mentioned concerning the same that is to say upon Trust that he the said John Chapman shall and so receive the rents and profits of all my said messuages or tenements and hereditaments and pay the same unto my daughter Ann Patey Wife of John Patey of Lambeth Sawyer during her life for her seperate use without the controul or intermeddling of her said present or any future husband and that her receipt above shall be a good and different discharge for the same and that the same or any part thereof shall not be subject or liable to the debts contracts or engagements of any husband of her and from and after the decease of my said daughter upon further trust that he the said John Chapman his heirs or assigns shall and do as soon after as conveniently may be duly and effectively convey all and singular my said messuages or tenements unto my two grandsons Thomas and John Patey children of my said daughter Ann Patey equally to be divided between them share and share alike and to their respective heirs and assigns for ever but if either of them shall dye in the life of my said daughter without issue surviving him then as to the whole in trust for the other of my said grandsons and his heirs and assigns for ever and if it shall happen that both my said grandsons shall dye in the life of my said daughter Ann Patey without issue living at their respective deaths then and in such case my said trustee and his heirs shall stand seized of my said estate In trust for my grandson Richard Beadle and my grandaughter Ann Beadle children of Richard Beadle of Wandsworth aforesaid carpenter equally to be divided between them share and share alike and to their respective heirs and assigns for ever and shall and do pay and apply and dispose of the rents and profits thereof for and towards the maintenance and education of my said grand children Richard and Ann Beadle until they shall respectively attain their ages of twenty one years And I give and bequeath unto the said John Chapman his Executors and Administrators all those my several leasehold messuages or tenements with their and every of their appurtenances situate lying and being at or near Wandsworth aforesaid and Hammersmith in Middlesex to hold the said leasehold premises unto the said John Chapman his Executors Administrators and Assigns for and during the remainder of the several terms of years therein respectively yet to come and unexpired subject to the ground rents and covenants reserved in the several leases under which I hold the same upon trust that the said John Carpenter shall and do pay and apply the rents and profits thereof unto my said daughter Ann Patey for and during her natural life for her separate use exclusive of her present or any other husband she may hereafter marry as aforesaid and from and after her death in trust that my said trustee shall and do transfer and assign the said leasehold premises unto my said two grandsons Thomas and John Patey to hold to them their executors and administrators during the residue and remainder of the several terms of years then to come and unexpired subject as aforesaid equally to be divided between them share and share alike to and for his and their own proper and absolute use and benefit but if it shall happen that either of them shall dye in the life time of my said daughter without leaving any issue surviving him then the whole to the other of them and his executors and administrators and if it shall happen that both my said grandsons Thomas and John Patey shall dye in the life time of my said daughter Ann Patey then and in such case in trust that the said John Chapman his executors and administrators shall and do transfer and assign my said leasehold estates unto my said grandson Richard Beadle and my grandaughter Ann Beadle equally to be divided between them share and share alike for all the remainder of my terms therein and I declare that in case they shall become intitled to any part of my said leasehold estates during their infancy the rents and profits thereof shall be from henceforth during the remainder of their infancy applyed towards their respective maintenance and education And I give unto my said grandson Richard Beadle and my grand daughter Ann Beadle the sum of twenty pounds a peice which I desire may be paid unto the said Richard Beadle their ffather within six months after my death for their use and that his receipt shall be sufficient discharge for the same and I give and bequeath unto my wife Sarah ten guineas for mourning and I give unto the said John Chapman five pounds for mourning and I give and bequeath all the rest residue and remainder of my goods chattels and personal estate and effects and wheresoever after payment of all my debts legacies and funeral expenses unto my said daughter Ann Patey her heirs and executors and admors unto and for their own proper use absolutely and for ever and seperate and apart from her said present or any future husband as aforesaid and it is my Will that her receipt above shall be a sufficient discharge for the same And I do hereby declare that the said John Chapman his executors or administrators shall not ne answerable or accountable for any more money than what he or they shall actually receive in respect of the trusts aforesaid nor shall be chargeable with or liable to make good any loss thereof or of any part thereof which shall happen without his or their wilful neglect or default and that he and they shall and may at all times deduct and retain to himself and themselves all losses costs charges damages and expenses which may arise or happen on account of the trusts aforesaid and I do hereby appoint my said wife Sarah and the said John Chapman immediate executors of this my last Will and if my said daughter Ann Patey shall survive her present husband then I appoint her also an executor hereof from and after his death And I revoke disannul and make void all former and other Wills by me at any time heretofore made and do make and declare this only to be my last Will In witness whereof I the said Nuce Sterry have to the first sheet hereof annexed set my hand and to this sheet set my hand and seal this fifteenth day of September and in the year of Our Lord one thousand seven hundred and seventy four - Nuce Sterry - Signed sealed published and declared by the said Nuce Sterry as and for his last Will in the presence of us who at his request and in his presence have respectively subscribed our names as witnesses Jas Tibbald, Edw Osbaldeston, William Willson

This Will was proved at London the twenty seventh day of September in the yeat of Our Lord one thousand seven hundred and seventy four before the Worshipful Andrew Coltee Ducarel Doctor of Laws Surrogate of the Right Worshipful Sir George Hay Knight Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oath of John Carpenter one of the Executors named in the said Will to whom administration was granted of all and singular the goods chattels and credits of the deceased having been first sworn duly to administer power reserved of making the like grant to Sarah Sterry widow the relict and one other of the executors named in the said Will when she shall apply for the same and also of making the like grant to Ann Patey wife of John Patey the daughter of the said deceased and the other executor named in the said Will upon the death of the said John Patey her husband if she shall then apply for the same.
