WILL OF RICHARD STERRY,
SURREY, 1786

 

I Richard Sterry of Hertford in the County of Hertford Gentleman do make this my last Will and Testament as follows ffirst I direct that all my just debts be fully paid and satisfied Item I give and bequeath unto my dear wife Mary Sterry my gold and silver watches my wearing apparel and all my household goods ffurniture china and linnen which shall be in or belonging to my dwelling house at the time of my decease and I give to my said wife the use of all my plate and books for the term of her natural life and at her decease I give the same equally between my two sons and in case my wife shall be minded to deliver the same or any part thereof to them or either of them at any time during her life time I do hereby will and permit her to do so And I give and bequeath unto William Wood of the parish of Saint John Southwark in the county of Surry Gentleman William Manser of Craigs Court Charing Cross in the County of Middlesex Gentleman and to my son Anthony Sterry and to the survivors and survivor of them and the executors and administrators of such survivor ____ annuity of three hundred and twenty pounds per annum payable at the Bank of England for the term of eighty years from the fifth day of January one thousand seven hundred and eighty upon trust nevertheless and to and for the several uses intents and purposes following that is to say upon trust to pay to or permit and suffer my said wife Mary to receive the same until my son Joseph shall attaine the age of twenty one years if he shall so long live and upon his attaining that age then upon trust to transfer to him the sum of sixty pounds a year part of the said annuities and to pay to or permit my said wife to receive the then remaining two hundred and sixty pounds a year of the said three hundred and twenty pounds a year long annuities for and during the term of her natural life and in case my said son Joseph shall die under the age of twenty one years then upon trust to transfer fforty pounds a year of the said long annuities unto my son Anthony Sterry his executors administrators and assigns And also upon such last mentioned event happening upon trust to pay into the proper hands of my brother Benjamin Sterry alone twenty pounds a year of the said long annuities for and during the term of his normal life my will being that the same shall not be any ways assigned or made over by him to any person or persons whomsoever and from and after his decease then to transfer the said twenty pounds a year long annuities unto and amongst all and every the child and children of the said Benjamin Sterry equally share and share alike when and as they shall respectively attain their age of twenty one years or day of marriage which shall first happen and in the mean time and until they shall attain that age or be married to pay apply and dispose thereof towards their maintenance and education But in case my said brother Benjamin Sterry should die without leaving any child or children then upon trust to transfer the said said twenty pounds a year long annuities into Ann Gingell wife of Joseph Gingell of Long Lane Southwark Gentleman and to Sarah Robins of the same place widow their executors or administrators equally or between them and from and after the decease of my said wife upon this further trust to transfer one hundred and fifty pounds a year part of the said two hundred and sixty pounds a year long annuities unto my said son Anthony Sterry his executors administrators or assigns and the then remaining one hundred and ten pounds a year of the said long annuities unto my son Joseph Sterry upon his attaining the age of twenty one years and in case of his death before such age upon trust to transfer one hundred pounds a year of the said one hundred and ten pounds long annuities unto my said son Anthony Sterry his executors administrators or assigns and the remaining ten pounds to continue upon trust to pay the same into the proper hands of my said brother Benjamin Sterry alone for and during the term of his natural life my will being that the same shall not be any ways assigned and made over by him to any person or persons whomsoever and from and after his decease then to pay assign and transfer the same unto and amongst all and every the child and children of the said Benjamin Sterry equally share and share alike at the times and in manner as the above mentioned sum or seventy pounds a year long annuities is hereinbefore ordered and directed to be paid and transferred to them But in case the said Benjamin Sterry die without leaving any child or children then upon trust to transferr the same unto the said Ann Gingell and Sarah Robins their executors or administrators equally between them and also I give and bequeath unto the said William Wood William Manser and Anthony Sterry and the survivors and survivor of them and the executors and administrators of such survivor the further sum of twenty pounds a year long annuities payable at the Bank of England upon trust to pay the same into the proper hands of my said brother Benjamin Sterry alone for and during the term of his natural life my will and mind being that the same shall not be any ways assigned or made over by him to any person or persons whomsoever And from and after his decease then to pay assign and transfer the same unto and amongst all and every the child or children of the said Benjamin Sterry equally share and share alike at the times and in manner as the beforementioned sums of money are hereinbefore ordered and directed to be paid and transferred to them But in case the said Benjamin Sterry shall die without leaving any child or children then upon trust to transfer the same unto the said Ann Gingell and Sarah Robins their executors or administrators equally between them Item I give and bequeath unto my said brother Benjamin Sterry the sum of one hundred pounds to be paid to him within six months next after my decease And I do give and remit unto my said brother Benjamin Sterry all such sum and sums of money as at the time of my decease shall be due from him to me for principal and interest on his bond given to me to secure the payment of ffifty pounds and interest Item I give and bequeath unto my said son Anthony Sterry all that my leasehold messuage or tenement and premises situate at the corner of Mint Street in the parish of Saint George Southwark now in his occupation and all the ffixtures thereunto belonging and all the ffurniture that shall be therein and belonging to me at the time of my decease to hold the said household messuage or tenement ffixtures ffurniture and premises with their appurtenances unto my said son Anthony Sterry his executors administrators and assigns for and during the remainder of the term of years whereby I lived the same and which at the time of my decease shall be to come and unexpired Also I give and bequeath unto my said son Anthony Sterry one bond obligation dated the twenty third day of March 1782 from six of the principal inhabitants of the parish of Saint George Southwark to me to service the repayment of ffifty pounds lent by me for the use of the said parish and all principal money and interest that shall be due thereon at the time of my decease Item I give and bequeath unto my said son Anthony Sterry one bond or obligation dated on or about the twenty fourth day of June last from Thomas Evan of Bow in the county of Middlesex wheelwright to use to secure the repayment of one hundred pounds and interest and also his note of hand to me of the same date to secure the payment of the further sum of twenty pounds and interest and all such principal money and interest as shall be due and owing to me at by and from the said Thomas Cook on the said securities at the time of my decease to and for his own use and benefit Item I give and remit unto Thomas Wagstaff(?) of Grace Church London all such principal money and interest as he shall owe and stand indebted to me on his bond at the time of my decease Item I give and bequeath unto the said Ann Gingell and Sarah Robins the sum of ffifty pounds each to be paid them respectively within six months after my decease Also I give and bequeath unto the said William Wood William Manser and Anthony Sterry and the survivors and survivor of them all those my twenty eight shares in the capital or Joint stock of and belonging to the Governor and Company for the melting down of lead with sea and pit coal and all my right and interest of in and to the same upon trust to sell assign or dispose of the same and pay the monies arising thereby within six months after my decease to the trustees for the time being of the six weeks meeting of the people called Quakers in London Item I give and bequeath to the trustees for the time being of the ffriends school or workhouse in Clerkenwell London thirty pounds to be paid to them within six months after my decease to be added to the capital stock of the said charity Item I give and bequeath unto the poor ffriends belonging to the meeting in Horsleydown Southwark twenty guineas to be paid to and distributed amongst them within six months after my decease at the discretion of the said meeting And I give and bequeath unto the said William Wood and William Manser and also to my said son Anthony Sterry besides what I have herein before given to them the sum of twenty pounds each for their trouble they will respectively have in the execution of this my Will and I direct that all the legacies herein before by me given and for the payment of which no particular provision is thereby made shall be paid out of such monies as I shall be possessed of and standing in my name at the time of my decease in the ffunds on Government securities and which are not hereby particularly disposed of and it is my mind and will that in case one or more of my said trustees shall happen to depart this life before the trusts hereby in them reposed are fully executed and performed then and in such case I hereby authorize and empower the surviving trustee or trustees by and with theconsent of my said wife to elect and appoint any other person or persons they shall think fit to be a trustee or trustees with them in the room and stead of such trustee or trustees so deceased and that the surviving trustee or trustees as aforesaid shall and so transferr the said several and respective trust monies herein before mentioned into the name and names of themselves and the said new appointed trustee or trustees for the purposes aforesaid and I do hereby direct that my executors and trustees and the survivors and survivors of them and the executors and administrators of such survivor shall and may retain and reimburse themselves out of my said estate and effects all such costs charges and expenses whatsoever as they or any or eithere of them shall or may sustain or be put into or which shall or may arise or be occasioned by means of the execution of the trusts hereby in them reposed and that my said executors and trustees shall not beanswerable or accountable the one for the other of them but each of them for his own act deed receipt and default only and as to the rest residue and remainder of my goods chattels monies estate and effects whatsoever and wheresoever whereof or whereunto I now am or at the time of my decease shall be possessed or interested in or intitled unto I give and bequeath the same unto my said wife and my said son Anthony Sterry equally to be divided between them share and share alike to and for their own use and benefit and I do hereby make nominate and appoint the said William Wood William Manser and Anthony Sterry executors of this my last Will and Testament hereby revoking and making now all other wills by me heretofore made and I do declare this only to be my last Will and Testament In witness whereof I the said Richard Sterry the testator have to this my last Will and Testament contained in four sheets of paper to the first three sheets thereof set my hansd and to this last sheet my hand and seal the sixth day of august in the year of our Lord one thousand seven hundred and eighty four - Rd Sterry Esq - Signed sealed published and declared by the said Richard Sterry the testator as and for his last Will and Testament in the presence of us who have hereunto subscribed our names as witnesses in his presence and at his request Mary Smith Fred Vincent Southwark

This is a codicil to the last Will and Testament of Mr Richard Sterry which I duly made and published bearing date the sixth day of August 1784 and which Will I do hereby ratify and confirm in all other respects viz I do give and bequeath unto William Wood William Manser and Anthony Sterry in my said Will named and to the survivor and survivors of them and the executors and administrators of such survivor the further sum of ten pounds a year long annuities payable at the Bank of England upon trust to pay the same into the proper hands of my brother Benjamin Sterry for and towards the maintenance education and bringing up of my nephew and niece Richard and Mary Sterry the son and daughter of my said brother Benjamin Sterry until they shall respectively attain the age of twenty one years or day or days of marriage which shall first happen and when and as they shall respectively attain their said age of twentyone years or day or days of marriage which shall first happen then to pay and assign and transfer the sume unto the said Richard Sterry and Mary Sterry equally between them share and share alike But in caes either of them the said Richard Sterry and Mary Sterry shall happen to die before he or she shall have attained the said age of twenty one years or be married as aforesaid then upon trust to pay assign and transfer the whole of the said ten pounds per annum long annuities unto such survivor at such day or time aforesaid to and for his or her own sole use and benefit and in case both of them the said Richard Sterry and Masry Sterry shall happen to die before they shall attain the said age of twenty one years and unmarried then I give the said ten pounds perannum long annuities to my said son Anthony Sterry to have for his own use and benefit to be paid assigned and transferred to him immediately upon the death of the survivor of them the said Richard Sterry and Mary Sterry dying as aforesaid Also I give and bequeath unto all and every my servants who then be living with me at the time of my decease if they shall have been in my service at least one year previous to the time of my decease the sum of five pounds each to be paid by my executors named in my said will within one month after my decease and I do also hereby declare that my said will in writing and this codicil which I will shall be added to and deemed part thereof to contain my last Will and Testament In witness whereof I have to this codicil contained in one sheet of paper set my hand and seal the twenty fifth day of November in the year of our Lord one thousand seven hundred and eighty five - Rd Sterry - signed sealed published and declared by the said Richard Sterry as and for a codicil to be added to and taken as part of his last Will and Testament in the presence of us who have hereunto set our names and witnesses in the presence and at his request witness - Anthony Neatby, Alice Edridge

This Will was proved at London with a codicil the sixth day of ffebruary in the year of our Lord thousand seven hundred and eighty six before the Worshipful William Macham Doctor of Laws Surrogate of the Right Worshipful Peter Calvert Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by William Wood William Manser and Anthony Sterry the executors named in the said Will to whom administration of all and singular the goods chattels and credits of the deceased was granted they having already made a solemn and suncere declaration or affirmation according to Act of Parliament duly to administer.
