WILL OF BENJAMIN STERRY,
SURREY, 1708

 

In the Name of God Amen. I Benjamin Sterry Citizen and haberdasher of London being in good health of body and of sound mind and memory praised be to God for the same doe make this my last Will and Testament in manner ffollowing ffirst I humbly comend my soul into the hands of Almighty my Creator trusting in and through his mercy and the merritts and intercession of Jesus Christ my Redeemer to obtain remission of all my sinns and a happy resurrection to life eternall my body I committ to the earth to be decently buried according to the discretion of my executrix herein after named and such worldly estate wherewith it hath pleased God to bless me I give devise and dispose the same as followeth Imprimis I give devise and bequeath unto my dear and loving wife Anne Sterry all my lands tenements and hereditaments whatsoever and wheresoever with their and every of their appurtenances to hold to her my said wife and her assignes for and dureing the terme of her naturall life charged neveretheless and chargeable with the payment of the yearly sume of twenty pounds at four equall quarterly payments in every year unto my uncle Joseph Sterry for and dureing the terme of his naturall life without any deductions to be made thereout for or in respect of any taxes charges or imposicons due and be payable at such of the feast dayes of the birth of our Lord Christ the Annunciation of the blessed virgin Mary the nativity of St John the Baptist or the feast of St Michaell the ArchAngel as shall first and next happen after my decease And from and imediately after the decease of my said dear wife I give devise and bequeath all and every my said Lands Tenements and Hereditaments with their and every of their appurtenances unto my loving son Mr John Marson his heires and assignes for ever charged nevertheless with the payment of the said clear yearly sume of twenty pounds to my said uncle Joseph Sterry in maner as aforesaid (if he my said uncle shall be then living) for and during soe long time and only as he my said uncle shall afterwards happen to live. Item I give to my cousin John Sterry of Wansworth ten pounds to my cousin Elizabeth Thompson five pounds to my cousin Sarah Sterry twenty pounds to Mrs Alice Eales(?) ten pounds to my maid servant Katharine Dobson ten pounds to my partner Mr Joseph Dunnell(?) for mourning for himself and his wife thirty pounds to my said son John Marson forty pounds and to my loving friend Phillip Oddy of Southwark Gentleman forty pounds All the rest residue and remainder of all my personall estate whatsoever after my debts legacies and ffunerall expences thereout first paid and discharged I give devise and bequeath unto my said dear wife Anne Sterry whom I make sole executrix of this my will desireing my said son John Marson and the said Phillip Oddy to be overseers of this my Will and to advise and assist my said Executrix in the execution of this my will and the due management of the estate hereby devised to her and I doe hereby revoke all and every other Will or Wills by me heretofore made and doe declare this to be my last Will and Testament In witness whereof I have hereunto sett my hand and seal this fifth day of December in the fifth year of the reign of our soveraigne Lady Anne by the grace of God of England Scotland ffrance and Ireland Queen defender of the ffaith xr. and in the year of our Lord Christ one thousand and seven hundred and six. Wheras by by last Will hereunto annexed bearing the fifth day of December which was in the year of our Lord one thousand seven hundred and six I have charged all my lands tenements and hereditaments with an annuity of twenty pounds per annum to be paid to my uncle Joseph Sterry during the terme of his naturall life I doe now by this codicill annexed to my said will revoke that part of my said Will and doe give and bequeath to my said uncle only the sume of ten pounds per annum for his life to be issueing and payable to him in such manner as the said annuity of twenty pounds p annum was by my said Will limitted and directed And I doe alsoe hereby give devise and bequeath unto my loving ffriends Phillip Oddy of the parish of St Saviours in Southwark Gent and Benjamin Thornbury of the same parish Grocer and to their heires for ever one annuity or yearly rent charge of five pounds of lawfull money of great Britain clear of all taxes charges and reductions whatsover to be issueing and payable by four equal quartley payments in every year out of all and every my lands tenements and hereditaments situate lying and being within the said parish of St Saviour in Southwarke or elsewhere in the county of Surrey all which I doe hereby accordingly charge with the payment thereof the first of the said quarterly payments to become one and payable at and upon such of the usuall ffeast dayes as shall first happen next after my decease to the intent and purpose and upon this speciall trust nevertheless that they the said Phillip Oddy and Benjamin Thornbury and their heirres shall and doe yearly and every year for ever pay the same to the respective Trears(teachers?) for the time being of the Charity Schools lately sett up for coaching poor boyes and girls to read ex within the said parish in the proportons following that is to say twenty shillings p annum part thereof to the treasurer of the Charity School for teaching boyes and the residue to the Charity School for teaching girles for ever And whereas (besides the revercon of my will estate after the decease of my wife) I have only given to my son Mason a Legacy of forty pounds I doe hereby give to my said son Mason out of my personall estate the further sume of five hundred and ten pounds makeing up in the whole five hundred and fifty pounds to be payable to him imediately after my decease I alsoe give to my said loving friend Phillip Oddy besides the legacy of forty pounds devised to him by my said Will the further sume of ten pounds makeing in the whole the sume of fifty pounds I also give to my maid servant Katharine Dobson besides the ten pounds devsied to her by my Will the further sume of fifteen pounds for her great care of me in my sickness makeing up in the whole the sume of five and twenty pounds I also give to my cousin Mason late of Newington Gent. ten pounds for mourning and to my cousin Richard Hatton gent. ten pounds for mourning All and every other the devises bequests and legacies in my said Will contained I doe hereby confirme and ratifye And my Will and Testament is that this Codicill or schedule be and be adjudged and taken to be part and parcell of my last will and testament and that all things herein contained and menconed be faithfully and trully performed and as fully and amply in every respect as if the same were declared and sett down in my said last Will and Testament In witness whereof I the said Benjamin Sterry the Testator in the Will annexed have hereunto sett my hand and seale this fourteenth day of October in the year of our Lord one thousand seven hundred and eight. Memorandum that this codicill was signed and sealed by the said testator Benjamin Sterry and the same together with the will annexed was published and declared by the said testator as his lastWill and Testament in the presence of us who have hereunto subscribed our names as witnesses in the presence of the said testator Edw Hodsdonn, W Thires, Phil Oddy, Higs Hofter

Probatum fuit huius Testamentum apud London coram venli viro Roberto Hood Legum Doctore Surrogato Venlis et Egregii viri domini Richi Raines Militis Legum etiam Doctoris Curia Prerogativa Cantuariensis Magistri Custodis sive Commissarii legitime constituti sexto die mensis Novembris Anno Domini Millesimo Septingentesimo Octavo Iuramento Anne Sterry relicta dicti defuncti et Executoris in dicto Testamento nominat cui commissa fuit administratio omnium et singulorum bonorum jurium et creditorum dicti defuncti de bono et fideliter administrando eadem ad Sancta Dei Evangelia jurat

This will was proved at London before the Worshipful Robert Hood Doctor of Laws Surrogate of the Venerable and Distinguished Richard Raines Doctor of Laws Master Keeper Commisary of the Prerogative Court of Canterbury lawfully constituted on the sixth day of November in the year of our lord one thousand seven hundred and eight by the oath of Anne Sterry relect of the said deceased and Executor named in the said will to whom administration was granted of all and singular goods chattels and credits she having been first sworn duly to administer on the holy Gospel of God.
