WILL OF ELIZABETH STERRY,
SURREY, 1704

 

In the Name of God Amen the seventeenth day of February Anno Din (Domini) 1702 in the __(?) yeare of the reigne of our Sovereigne Lady Anne by the Grace of God Queen of England Scotland ffrance and Ireland defender of the faith I Elizabeth Sterry of the parish of St Saviour in Southwark in the county of Surrey widdow ______ weak in body but of sound and perfect mind and ________ unto Almighty God _________ this transitory life I do therefore make and ______ last will & testament in manner following that is to say ffirst and principally I commend and ____ my Soul into the hands of Almighty God my maker and creator and of his sonn Jesus Christ my only Saviour and Redeemer whom in the _______ of whose most bitter death and passion I stedfastly hope to be saved my body I commit to the Earth from whence it came to be in decent and Christian like manner brought to the ground and buryed at the discretion of my Executor hereinafter named And as touching and concerning all such worldly goods and ___ as the Lord of his mercy hath blessed me with I doe give and dispose of the same after my debts paid and ffunerall expenses discharged in manner and forme following that is to say Inprimis I give and bequeath unto my loving sonn George Sterry the summe of one hundred pounds of lawfull money of England Also I give and forgive to him my said sonn George Sterry the one hundred and fifty pounds which he owes me and all interest moneys that will be and for this same at my death. Also I give to my said sonn George Sterry five broadpeices of old gold called Jacobus's and five other twenty shilling peices of old gold provided alwayes and my will and mind further is that if any loss or losses shall happen to my Estate in respect of the moneys and debts oweing to me from Thomas Avelin Gardiner from Stephen Vineyard senior Stephen Vineyard Junr and from John Woodgate Groter(?) then and in such case my said sonn George Sterry shall loose and abate out of the said legacyes to him hereby bequeathed and remitted as aforesaid one full half part of all such loss and losses happening to my estate by the severall debts and debtors before mentioned anything to the contrary notwithstanding Item I doe give and bequeath all my Lands Tenements and Hereditaments situate lying and being in Ruardean in the county of Gloucester or else where in the same county with the appurtenances to my loveing sonn William Sterry and his heires and assignes for ever Item I give and bequeath unto my loveing Grand daughter Elizabeth Sterry the daughter of my said sonn George Sterry the sume of one hundred pounds of lawfull money of England to be paid to her at her age of one and twenty yeares or day of marriage which shall first happen. The Interest thereof in the meanetime ariseing and to be made of the same I will shall goe and be applyed toward the increase of her portion And in case she my said Grand daughter Elizabeth Sterry shall happen to dye before her said age of one and twenty yeares or day of marriage which first happens then I give one moiety or half part of her my said Grand daughter's portion or legacy aforesaid to my said sonn George Sterry and the other moiety or half part there of I give to my said sonn William Sterry Item I give and bequeath unto my cozen John Gaines the summe of five pounds of lawfull money of England Item I give and bequeath unto my neece Sarah Burcher the sume of five pounds of lawfull money of England Item I give unto my cozen Elizabeth Burcher the daughter of my said neece Sarah Burcher the sume of five pounds of lawfull money of England to be paid to the said Sarah for the use of her said daughter within six months (?) next after my decease and interest(?) for the same shall be a sufficient ___________. Item I give and bequeath unto my loving nephew John Graves(?) the sume of five pounds of lawfull money of England Item as touching my best ffeather bedd and any other furniture thereunto belonging with my Green Curtaines belonging to the same one dozen of drapernapkins and a diapersaule(?) cloath and four pair of hollandsheete and four pair of pillowbeers(?) all which are at my sonn George Sterrys house I give the same to my said Grand daughter Elizabeth Sterry Item I give to my said sonn George Sterry all the other goods which are at his house except the plate linnen and all other things which are in my Cyprus Chest there Item I give to my loveing friend William Surflet twenty shillings to buy him a ring to weare in remembrance of me The rest residue and remainder of all and singular my ready moneys goods chattells debts oweing to me leases and all other estate whatsoever and wheresoever herein before disposed __ I doe give and bequeath unto my said loveing sonn William Sterry And I doe make and ordaine him my said sonn William Sterry full and sole executor of this my last Will and Testament And lastly I doe hereby revoke all former and other wills whatsoever by me made or spoken and none to stand force but this my Will only In witnesse whereof to this my last Will and Testament containing three sheetes of paper with this last sheete I have set my hand and seale to every sheete and affixed my seale to the whole or top of the first sheete the day and yeare in the first sheete first above written Elizabeth Sterry her marke Signed sealed published and delivered by the said Testatrix as and for her last Will and Testament in the presence of us who have hereunto subscribed our names as witnesses in the said Testatrix presente viz William Powell, Elizabeth Vineyard her marke ,Wm Surflet Snr(?), Tho Pettit his servant

Probatum fuit humor Testamentum apud Londen coram venti viro Nathaniele Lloyd Legum Doctore surro ventis et eque___ viri eni Richard Rames Militis Legum etiam ____ curie prerrogative cantu ad magiotri custodis sive comissarii _ime constituti primo die mentis ffebruarii anno dni __ ___ millimo sepingemo (sepingentesimo) tertio juramento Gulielius Sterry filii dicta defuncta et executoris indicto testamento benorum __ium et creditorum dicta effa__ et fideliter admstrand

This will was proved at London before the Worshipful Nathaniel Lloyd Doctor of Laws Surrogate of the Right Worshipful Richard Rames Doctor of Laws Master Keeper Commisary of the Prerogative Court of Canterbury lawfully constituted on the first day of February in the year of our lord ___ ___ one thousand seven hundred and three by the oath of William Sterry son of the deceased as written and the executor named in the said will to whom administration was granted he having been first sworn duly to administer on the holy Gospel of God.
