WILL OF FRANCES STERREY,
OF LONDON, 1682
In the Name of God Amen. I Frances Sterry of London widdow being reasonable well in health of Body and of a sound mind and perfect memory (God be praised) Doe make and ordaine this my last will and testament in manner and form following (That is to say) First I give and bequeath my soule to God my Gratious Creator And my body to the Earth to be buryed in such decent and private manner as my Executor hereafter named shall think fitt hoping for a glorious resurrection of my body from the earth And for the reuniting of my soul and Body in Glory Through the Redemption That is in Christ Jesus my Saviour And whereas God hath blessed me with an Estate in money which is now remaining in the hands of Sr Patiense Ward Knight and now Lord Mayor of the City of London for which he the said Sr Patiense Ward hath att my request given his bond to me. Now my will and mind is and I doe hereby give and devise to my son Peter Sterrey five hundred pounds And I give to my Grandson Peter Sterry son of my said sonn Peter Sterrey two hundred pounds Item I give and bequeath to my Grandsonn Ffrancis Sterry the other sonn of my said sonn Peter Sterrey the like sume of two hundred pounds. And to the child wherewith my said sonne Peter Sterrey's wife now goes (and in case that child wherewith she now goes shall happen to dye) then to the next after borne child of his one hundred pounds which said severall summs of money soe by me herein before bequeathed unto my said sonne Peter Sterrey and his children I will shall be paid out of the said money which is now owing unto me and remaining in the hands of the said Sr Patience Ward in manner and forme hereafter in this my last will and testament lymitted(?) and appointed (That is to say) I doe hereby lymitt(?) and appoint And my will desire and meaning is that the said severall legacies by mee given to my said sonn Peter Sterry and his children as aforesaid amounting in the while to the som of one thousand pounds, shall be ordered disposed improved and paid by my Executor herein for that purpose after named in manner and form following in this my last will and testament herein after mentioned (that is to say) That all the said sume of one thousand pounds shall be put forth and remain att interest by and according to the discretion of my executor to that purpose herein after named And my will and mind is that the Executor to that purpose herein after named shall reteine and pay the whole interest thereof to my said sonn Peter Sterrey for and during his naturall life halfe yearly or as the same can be received for and towards the better maintenance of himselfe and family And my will and mind of within is that the said so ___(?) legacies by mee given to the children of my said sonne Peter Sterrey as a surisued(?) shall from and after the decease of my said sonn Peter Sterrey be improved by my executor to that purpose herein after named att his discretion for the best advantage (as ____(?) as he can) of the said children until the boyes shall attaine unto their respective ages of one and twenty yeares And if such after borne child shall be a girl untill she shall attain unto her age of one and twenty yeares or day of marriage. Att which respective times my will and mind is that their severall and respective legacies with the proceed(?) and improvement of them shall be severally and respectively paid and delivered to their owne proper hands and custody or to the proper hands and custody of the survivor or survivors of them except such part of the proceed and improvement thereof as my Executor to that purpose herein after named shall think fit to allow towards the maintenance and education of the said children And I do hereby further will and appoint that my executor to that purpose herein after named shall frans(?) and after the decease of my said sonn Peter Sterrey pay to my daughter in law the now wife of my said sonne Pater Sterrey in case she shall survive her said husband sixteen pounds a yeare during the term of her natural life halfe yearly out of the interest of the said sume of five hundred pounds before by me herein appointed to be paid to my said sonne Peter during his naturall life as aforesaid And the other and residue of the interest of the said some of five hundred pounds to goe imediately and be improved and disposed of from and after the decease of my said sonn Peter Sterrey for the benefitt and advantage of all and every of the children of my said sonne Peter Sterrey and the survivors and survivor of them. Item I do hereby further declare my will and mind to bee that from and after the decease of my said daughter in lawe the whole interest and benefitt of the said legacies of five hundred pounds shall be likewise so disposed and imporoved by my executor for that purpose herein after named for the benefit and advancement of such children of my said sonn Peter Sterrey lawfully begotten shall be then living And shall be paid to them or the survivors or survivor of them respectively together with the said whole principall legacie of five hundred pounds att such days and times and in such manner and forme as the other severall legacies herein before by me bequeathed unto them respectively shall become due and payable equally part and part alike. And my will and mind further is And I doe hereby declare my true intent and meaning to be that if my said sonn Peter Sterry shall not att the time of his decease have any children of his body lawfully begotten behind him then and in such case all the said severall and respective legacies herein before by me given to them as aforesaid (amounting to the whole to the said some of one thousand pounds) shall be paid by my executor for that purpose herein after named to my sonn Joseph Lee Sterry and my daughter Frances Webb and their children equally to be divided amongst them part and part alike And further if my said sonn Joseph Sterry and my said daughter Francis Webb shall both of them happen to dye or decease and have noe child or children behind him or her liveing then and in such case I will that all the said som of one thousand pounds together with the interest and proceed thereof shall be paid by my executor for that purpose herein after named To my sonne George Underwood esquire and my daughter hill equally to be divided between them part and part alike. Item I give and bequeath to my sister Wormell my black damaske bedd and three blue cushions Item I give to my daughter Webb my black ebony cabinett and my silver cupp and lidd And I doe desire my said daughter webb and her husband and my sonne webb that they will take care that after the death of my said daughter webb the sonn may be given to their daughter Gratianna Webb. Item I give devise and bequeath all my lands att helgay(?) to my said sonne George underwood and his heirs if the same be not already will conveyed to him upon and under this conditon nevertheles that he my said sonne George underwood doe and shall acquitt and discharge mee my heires executors and administrators of all debts and demands whatsoever. Item I give and bequeath to my said sonns George underwood and Joseph Lee Sterry all my lynnen to be equally devided between them Item I give to my said sonne Peter Sterry all my bedding and the rest of my houshold stuffe and hangings which I have not or shall be otherwise dispose of Item I give and bequeath to my worthy friend Mrs Mary Rushoul(?) my saphire ring. The rest and residue of all and every my goods chattels debts ready money and personall estate whatsoever not herein by me particularly bequeathed after my debts ffunerall charges and the legacies by me herein given shall be paid I give and leave to and amongst all and every the children of my said sonne Peter Sterrey equally to be divided between them or the survivors or survivor of them part and part alike Item I give and bequeath to my brother Mr Nathaniell Sterrey ffive pounds and to each and every of my children unmarried ffive pounds a peice to buy each of them mourning Item give to my sonne Peter Sterry tenn pounds to buy him and his wife mourning And to my said daughter Frances Webb and her husband the like some of tenn pounds to buy them mourning Item I give to my grandchild Dren Rowland hill and to my grandchildren Gartiana webb Persis webb and Mary webb children of my said daughter webb and to each and every of them five pounds a piece And I doe hereby make ordaine and appoint my said welbeloved sonne George Underwood Esquire sole executor of this my last will and testament (except as to that part and for much thereof as doth in any wise concerne the legacys given to my sonne Peter Sterry his wife and children I doe ordaine make and appoint my said wellloved brother Nathaniell Sterry clerke Dean of Barking in the County of Essex my sole Executor) And it is my will and mind that my said Executor to that purpose last above named shall not runn any hazard nor sustaine any losse or damage by reason of any losses that shall or may happen by his ordering of the legacies given to my said sonne Peter his wife and children. And I doe hereby renounce and revoke all former wills and testaments by mee stt any time heretofore made And doe declare this to bee and stand for and as my only last will and testament In witnes whereof I the said ffrances Sterry have to every sheete of this my last will and testament conteyned in seavin sheetes of paper subscribed my name And as well to every of the said sheetes as to the labell on the topp thereof affixed sett my seal the nineteenth day of Aprill Anno Dei 1651. Whereas on the nyneteenth day of Aprill 1681 I made my this last will and testament which I still declare to be my last will except fforty words which by my order I have (?) to be put out and blotted and instead thereof I doe by these presens further declare that whereas my sonn Peter Sterry hath contracted a debt of one hundred pounds I do give him towards(?) the payment thereof ffifty pounds And I doe ordaine that if he saunelt(?) then wife pay the other fifty then it shall be paid out of the five hundred pounds by me setled(?) on him. Item I give unto my beloved daughter Grace Suckley the sum of eighty ffive pounds And to her husband my son Ralph Suckley the sum of ffive pound for mourning And I do further declare that if my estate doe not hold out to pay my depts legacies and funerall charges that then and in such case the intres(?) of my whole estate for the space of halfe a yeare next after my death shall goe towards the performance of my whole will provided my ffunerall charges doe not exceed twenty ffive pounds or thirty att the uttermost In witnes whereof I have sett my hand and eale this eleaventh day of July Anno Dei 1682 And in the ffoure and thirtieth yeare of our sovereign lord Charles the Second. Whereas I made my then last will and testament on the nyneteenth day of Aprill Anno Dei 1681 I therein gave my sonn Peter Sterry ffive hundred pound but noe power to dispose of it otherwayes then to injoy the inters(?) now be it known that upon good consideration my will and mind is that if att any time my honored brother Mr Nathaniell Sterry Dean of Bocking shall see it convenient rather to purchase a place or otherwise for his preferment and advantage of his future liveing that is such case he my said brother may give him my said sonne Peter Sterry leave to dispose of part of the said ffive hundred pounds by mee given soe as it doe not exceed two or three hundred pounds And I further will and declare that what by mee was given my sonn Joseph Lee Sterry in the said will shall goe towards the payment of my debts lagacies and ffunerall by ne given in that will and an additional will by me made the eleventh of this instant And if all my estate will not satisfy my said wills and testament then the whole estate to remaine att interess till there be enough witnes my hand and seal this 13th of July 1682. Probatum fuit testamentum suprascriptum apud London cum inobus codicillis annex coram venle viro dno Richardo Lloyd milite legum doctore surragato venerabilis et egrigii viri dni Leolius Jenkins militis etiam et Legum Dtoris curia prerogativa canto magri custode sui comisarii litime constituto viresimo octavo die mensis Julii anno domini millimo sexecutismmo octogesimo secundo iuramento Georgii Underwood cuius executorum in dico testamento nominat cui comssa fuit administrato omnium et singulorum bonorum iurium et heditorum deta(?) defuncta (exciptis quibus dam legatis Petero Sterry filio dicte defuncta ejus uxoris et liberis in dris testamento et codicillis lpiatr donatis) de vini et fideliter administrando bona iura et cocdita iuta defuncta (legatis pro Petro Sterrey iusqe uxoris et liberaris sempre et per sertur exoretis) ad sancta dei evangelia iurato. Reservata ptati probatorum icoy testamenti et codicillorum cuistatam (?) Nathannelis Sterrey executoris etiam in dco testamento nominati futiendi gnoad coutirnit dra legata prafatis Petro Sterrey uxoris et liberis cuis donata sed non ultra not alr Cum icus Nathaniel Sterrey venerit eadem probatorum linistatum petiturus.
This will was proved at London together with the codicles before the Worshipful Richard Lloyd military Doctor of Laws surrogate of the venerable and distinguished Leolius Jenkins also military Doctor of Laws of the Prerogative Court lawfully constituted on the twenty eighth day of July in the year of our lord one thousand six hundred and eighty two by the oath of George Underwood executor named in the said will to whom administration was granted of all and singular goods chattels and credits (except that part relating to Peter Sterrey mentioned above) he having been first sworn duly to administer on the holy Gospel of God. Reserved probate relating to the testament and codicle to Nathaniel Sterrey also executor named in the will.
