WILL OF JOHN STERRY,
SURREY, 1735
In the Name of God Amen. I John Sterry of the parish of Wandsworth in the County of Surry Carpenter being in good and perfect health of Body and of sound and perfect mind and memory praise be given to Almighty God for the same knowing the uncertainty of this life on Earth and being desirous to settle things in order doe make this my last Will and Testament in manner and form following (that is to say) first and principally I commend my soul to Almighty God my Creator assuredly believing that I shall receive full pardon and free remission of all my sinns and be saved by the precious death and merits of my blessed Saviour and Redeemer Jesus and my body to the Earth from where it was taken to be buried in such decent and Christian manner as to my Executrix hereafter shall be thought meet and convenient and as touching such worldly Estate and Goods as the Lord in his mercy hath lent and bestowed upon me my Will and meaning is the same shall be imployed and bestowed as hereafter by this my Will is expressed and set forth And first I do revoke renounce frustrate and make void all Wills by me formerly made and declare and appoint this to be my last Will and Testament. Item I give and bequeath unto my loving son John Sterry all that my freehold messuage or tenement being the further most house of my three houses situate and being on the Bank side Southwark and lying westward there immediately after the decease of my loving wife Cornelia Sterry Item I give and bequeath unto my loving son Nuce Sterry all that my other freehold messuage or tenement being the middlemost house of the three houses on the Bank side Southwark from and immediately after the decease of my said wife Cornelia Sterry Item I give and bequeath unto my son Samuell Sterry the other my freehold messuage or tenement of the said three houses on the Bank side Southwark of which he is already in possession Item I give and bequeath unto my daughter Rachell now the wife of James Harrison the summe of one shilling and no more to be paid to her within one month after my decease by my Executrix hereafter named Item I give and bequeath unto my loving son Samuell Sterry all those my Messuages or Tenements situate and being in the Dutch yard in Wandsworth which I now hold by lease from the Duke of Bedford and all ground and appurtenances thereto belonging as also all those my severall Messuages or Tenements which I hold by lease situate and being in Hammersmith in the County of Midx from and immediately after the decease of my said wife Cornelia Sterry Item I give and bequeath unto my son Nuce Sterry all that lease of the houses and estate late belonging to Abraham Warwick as also the houses I hold by lease lately belonging to Mr Hebborne as also the house I now live in in Wandsworth from and immediately after the decease of my wife Cornelia Sterry Item I give and bequeath unto my dear and ever loving wife Cornelia Sterry all and singular my household goods and implements of household as Bedding Brass pewter and all other necessarys that shall be standing and remaining in the house I now dwell in at the time of my decease for and during the term of her naturall life and my further Will and meaning is that all such household goods as did belong to my said wife before my intermarriage with her that my said wife shall have power to dispose of the same at the time of her decease to such person or persons as she shall think fit in case I shall happen to survive my said wife then the said goods so formerly belonging to her shall not go such persons as she shall bequeath the same till after my decease Item I give I give and bequeath unto my said loving wife Cornelia Sterry all my ready money and all my Book debts, Bills, Bonds, Notes and other securities for money as also all and singular my severall leases in Wandsworth and Hammersmith as also all my freehold estate within the Kingdom of Great Britain and all manner of Benefit and advantage that may arise therefrom for and during the term of her naturall life Item I give and bequeath unto my sons Samuel Sterry and Nuce Sterry after the death of my said wife Cornelia Sterry all and singular my household goods that belonged me before my intermarriage with her to be equally divided between them share and share alike but they to have noe power to intermeddle with any the goods formerly belonging to her and which she hath a power by this my Will to dispose of as she shall think fitt and my further Will and meaning is that my said sons Samuel Sterry and Nuce Sterry shall lay out and expend the sume of ten pounds in paying and discharging the funerall charges of my said wife Cornelia Sterry and see her decently interred and that their own mourning shall not be included therein or be any apart thereof and my further will and meaning is that my sons Samuell Sterry and Nuce Sterry shall each of them pay to my son John Sterry the fume of ten pounds a peice as a further token of my love to him Item I give to my wife Cornelia Sterry all my stock of timber of what kind soever that shall be in my possession at the time of my decease to dispose of them to her own use and benefit and further it is my will and meaning that in case any of my sons shall at any time after my decease shall create any difference or dispute concerning their share of my estate so devised and bequeathed amongst them contrary to this my will that he so quarrelling shall forfeit and be debarred of the legacy hereby given to him and shall have no more then one shilling from his share and Lastly I do hereby make ordain nominate constitute and appoint my said loving wife Cornelia Sterry to be my whole and sole executrix to this my last Will and Testament and do appoint my loving brother Joseph Sterry Citizen and Tinplate maker and my Brother in Law William Millen Citizen and porter of London to be my Executors in trust to see this my Will fully and punctually performed and to assist my wife in securing her just right and do give to each of them for their trouble therein to each of them two guineas apiece In Witness whereof to this my said last Will and Testament I have hereunto sett my hand and seal the twelfth day of August in the year of our Lord God 1734. This Will was proved at London the first day of February in the year of our Lord one thousand seven hundred and thirty four before the Worshipfull John Andrew Doctor of Laws Surrogate to the Right Worshipfull John Bettesworth Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oath of Cornelia Sterry widow the relict of the deceased and sole Executrix named in the said Will to whom administration was committed of all and singular the Goods Chattles and Credits of the said deceased being first sworn duly to administer.
